Terms Of Service

General information

1. By purchasing any of my services, you have automatically accepted my ‘Terms of Service’ and must oblige to follow them.
2. You are only buying a digital file. Once the commission is completed, please download the file as I frequently delete files.
3. I reserve the right to increase the payment of a commission depending on the complexity or if edits are required. This will be discussed before the invoice is sent.
4. I reserve the right to refuse a commission if it contains anything I am unable/ uncomfortable with drawing. I will not draw copyrighted characters and poor behaviour on your part will also cancel the commission.
5. Refunds are not available. Please refer to ‘REFUNDS/ CANCELLATIONS’ for more information.
6. Commissions will be done in art styles provided. I will not copy the artstyle of other artist.

Process

7. A grayscale sketch will be provided based on the form provided. Here you are able to ask for three edits. After three edits, you will be charged, please refer to ‘12’. Afterwards, I will proceed to finalise the commission piece.
8. You may ask for updates during the commission process at any time, however, I reserve the right to deny, or give a watermarked version of the incomplete commission.
9. When the commission is complete, I will send the digital file through Google Drive, you may ask for edits. After one edit, you will be charged, please refer to ‘12‘. I reserve the right to decide whether or not to make the modifications.
10. Under no circumstances will I redraw or refund a completed commission. To avoid being unsatisfied with a commission, please ensure the form provided is clear and concise. You may simply commission me again to receive the piece you had in mind, with the correct information. Please refer to ‘REFUNDS/ CANCELLATIONS’ on this list.
11. You can ask for a deadline but don't put pressure on me if your drawing isn't done in the next 2 days. The standard wait time is 3 weeks depending on my current waitlist. You can check the status of your commission here

Payment

10. If the commission is requested through Ko-Fi, the payment will be upfront.
- If the commission is a special request:
a) You must either be the owner of the Paypal account, or the owner of the account understands the nature of this purchase and that it will not be physically shipped.
b) Payment will be discussed and agreed upon before an invoice is sent.
11. You will only receive the digital file(s).
When the commission is at the sketch or completed phase, edits can be requested, but charges will be added after a set amount. Charges will vary.
12. Edits that are requested must be minor and not significantly differ from the original image.
a) Sketch: After three free rounds of edits, any additional change will be subjected to a charge of 20%-70% of the original price.
b) Completed: After one free edit, there will be a charge that can range from 20% to 70% of the original commission price.
13. A complete redraw of an unspecified commission piece will be denied.
14. Payment on edit charges will be requested when the commission has been completed. You will only receive your final files afterwards.
15. Additional money added on top of the final fee will be considered a tip and will not influence the final outcome of the artwork.

Refunds and cancelations

16. Refund requests are not available once the payment has been sent. The service I provide will be regarded as completed and you lose the right of revocation.
17. If the commission has not been completed on my behalf after 6 months, you will be refunded according to the progress that has been made.
> Sketches: 80% refund from the final price.
> Line art: 60% refund from the final price.
> Coloured: 40%-20% refund from the final price.

Permitions and Copyright

18. Only I, the artist, have full copyrights over my artwork. I am allowed to use the copyrighted artwork, including but not limited to; Promoting myself within any place or site. Post/ display the picture anywhere I want (credit will be given to the commissioner). Publish books with it.
You may request for the artwork to not be uploaded publicly, however, this must be stated in advance following with a fee (+20% of the original price).
19. The commissioner is allowed to; Use the copyrighted artwork for personal use and commercial use.
> For personal use only (profile pic, wallpaper, etc). Feel free to post or print the commission for your OWN USE, as long as you do not claim the work as yours or is used to gain personal profit. Please provide proper credit when posting on social media.> For commercial use, limits are applied and can only be exclusively used on Youtube and Twitch. For all commissions, the original purpose of the art must be maintained and you can choose between this options:a) Shared rights: The commission will be own by me but you would be free use the image but with visible credit of who made the art and no modifications to the piece. Additionally with a fee of 70% of the commission price.b) Full rights: The commission will be own by you and no credit will be require or expected. Additionally with a fee on top of the original commission price.> If you would like to turn your commission into merch or part of your merch, you would have to discuss it with me and you can choose between this options:a) Fee for product: that means that I would have to add a fee for allowing you to sell it as one product (stickers, postcards, etc). If you wanna put it in another type of product you would have to ask for permission again and pay another fee. For this option, I would need to know the number of units that you plan on making and I will retain ownership of the commissionb) Fee for merch: this means that the drawings will be use in many different types of merch products, the fee will be higher and you will be able to use the commission indefinitely on multiple products. I will retain ownership of the commissionc) Full exclusive right: I no longer have ownership of the commission and you can do as you please with it. Higher fee and me signing over full ownership20. The commissioner is not allowed to; change, modify, trace or use my works without my permission. You may not sell any merchandise with my art, this includes but is not limited to, t-shirts and other clothing, mugs, plushies, pins, jewellery, figures, phone accessories, stickers, prints, and replicas WITHOUT MY PERMITION and you may not take credit for my art.
22. If the original purpose of the art is altered without permission, actions will be taken and commissioner rights will be revoked.
23. It is strictly prohibited if the commission is used in any association with non-fungible tokens, cryptocurrency, or blockchains. Commissioner rights will be revoked and actions will be taken.
